The transformation and the formulation of the principle of Islamic Law In the sharia banking

Abstract


Abstract.Based on the Act Number 21 The year 2008, be sharia banking business activities in Indonesia have particularities compared with conventional banks. The particularities of are the obligation to fulfill the principles of shari'a in running its activities. The terms of the principle of the shari'a is a change from the principles found in Act Number 7 The year 1992. Sharia principle as mentioned in Article 1 number 12 is the principle of Islamic law based on a fatwa issued by the institution that has the authority in the assignment in the field of the shari'a. This research aims to know the transformation process and the formulation of the basis of Islamic law in Islamic banking. Based on the results of research it is known that the transformation of the basis of Islamic law in Islamic banking can be done not only through the laws only, but also through the other way by referring to the source of formal law. The formulation of the basis of Islamic law in Islamic banking in addition to formulated in legislation also can be done in other forms by institutions that are related to the sharia banks such as BI, OJK, DSN-MUI.
